HOUSTON - In response to discriminatory treatment he believes was left unchecked that resulted in his termination from Beavex Inc., Harris County resident Cedric Denson has filed a lawsuit.
Recent court records show the litigation was originally launched in Harris County District Court on Feb. 8.
Houston federal court received the case on May 22.
Beavex hired Denson in 2009, and at the time of the purported events which are the focus of the suit, the defendant employed him as a second shift dispatcher.
The original petition asserts that Beavex subjected Denson to "unfair and unequal" employment practices since he was the only black man working for the company in managerial capacity.
According to the complainant, Hispanic and white female employees, particularly a worker named Diana Montemayor, kept consistent surveillance on him as well as scrutinized his actions.
Denson further shows Montemayor, who is a co-defendant in the suit, eventually became in charge and practiced favoritism and nepotism to his detriment.
An incident on Apr. 10, 2012, in which the plaintiff made the judgment call to proceed on other routes supposedly because of another driver's tardiness and lack of information in the business's system prompted the respondent to fire him.
The suit argues that Beavex did not go through the proper channels of discipline, insisting Denson "was falsely never offered a performance improvement plan" before he was dismissed while non-black employees were afforded the opportunity.
A jury trial is requested.
