Woman claims Denton Wal-Mart bathrooms not ADA accessible

SHERMAN - An Illinois resident has filed a lawsuit claiming that a Denton Wal-Mart was not handicapped accessible. 

Jonna Bloodworth and Jaime Blanton filed suit against Wal-Mart Real Estate Business Trust on June 11 in the Eastern District of Texas, Sherman Division.

Bloodworth, who is an Illinois resident and a qualified individual with a disability under the ADA, claims Wal-Mart violated the Americans with Disabilities Act by failing to have proper wheelchair accessible toilet stalls.

According to the lawsuit, the wheelchair accessible toilet stalls did not have proper side grab bars with minimum structural strength required, or did not have side grab bars at all, and the restrooms had no method of providing a grab bar in the required position.

The defendant is accused of violation of the Americans with Disabilities Act and violation of the Texas state law against discrimination.

The lawsuit is asking for the court to declare that the property owned and administered by the defendant is violated of the ADA, to direct the defendant to alter its facilities to make them accessible and useable by individuals with disabilities, and for an award of attorney’s fees and court costs.

The plaintiffs are represented by Edward I. Zwilling of Schwartz Roller & Zwilling in Birmingham, Ala.

U.S. District Judge Ron Clark is assigned to the case.
