Accounting clerk sues for overtime wages

SHERMAN - An accounting clerk has filed a lawsuit against her employer claiming she was not paid overtime wages for the hour she worked “off-the-clock” before her normally scheduled hours. 

Anh Ngo filed suit against Total Transportation Services on June 21 in the Eastern District of Texas, Sherman Division.

Ngo worked for the defendant as a non-exempt accounting clerk from approximately 2007 until May 2013. According to the lawsuit, she was paid on an hourly basis and was paid overtime for some of the hours she worked, but not all of them.

The defendant is accused of violating the Fair Labor Standards Act by not paying Ngo at time and one half her regular rate of pay for hours worked in a workweek in excess of 40 hours. Ngo was not compensated for “off-the-clock” hours she was worked in the mornings before the start time of her normally scheduled hours.

The plaintiff is seeking an award of damages for compensation for overtime wages, unpaid wages, liquidated damages, punitive damages, attorney’s fees, court costs and interest.

Ngo is represented by Southlake attorney Chris R. Miltenberger. A jury trial is requested.

U.S. District Judge Richard A. Schell is assigned to the case.
