Man says son's fatal wreck caused by mom, driver trying to switch seats

An Arizona man has filed suit against his son’s mother, saying she caused his 4-year-old boy’s death when she attempted to switch drivers while operating a vehicle on the interstate. 

James Michael Kramer claims his recently deceased son, Preston Ray Kramer, was riding with his mother, defendant Nicole Antoinette Hathaway, on the interstate in Pecos County, Texas, on July 1.

Co-defendant Sydney Taylor Hathaway and Nicole Antoinette Hathaway were trying to switch drivers when they rolled the vehicle, resulting in Preston Ray Kramer’s death, according to the complaint filed July 5 in Jefferson County District Court.

In his complaint, James Michael Kramer is seeking a judgment within the jurisdictional limits of Jefferson County District Court, plus pre-judgment interest at the maximum rate allowed by law, post-judgment interest at the legal rate, costs and other relief the court deems just.

Scott W. Stover of Seale, Stover and Bisbey in Jasper will be representing him.

The case has been assigned to Judge Bob Wortham, 58th District Court.
