Fireworks warehouse worker sues for overtime wages

TYLER - A warehouse worker for a fireworks company has filed a lawsuit against his employer claiming he was not paid overtime wages.

Anthony Bell filed suit against Jake’s Fireworks Inc. on Aug. 18 in the Eastern District of Texas, Tyler Division.

Bell worked for the defendant from October 2012 through January 2013 as a warehouse worker. 

Bell claims that during his employment with the defendant he worked in excess of 40 hours during one or more weeks.

The defendant is accused of failing to pay Bell one and one-half times his regular rate of pay for each overtime hour worked.

The defendant is accused of violating the Fair Labor Standards Act.

The plaintiff is seeking an award of actual damages, compensatory damages, liquidated damages, attorney’s fees, interest and court costs.

Bell is represented by Charles L. Scalise and Daniel B. Ross of Ross Law Group in Austin. A jury trial is requested.

U.S. District Judge Michael H. Schneider is assigned to the case.
