MARSHALL - An accounting manager has filed a lawsuit against her employer claiming it violated her rights by failing to provide reasonable accommodations when she broke her leg.
Robin Obenoskey filed suit against Eastex Crude Co. on Aug. 26 in the Eastern District of Texas, Marshall Division.
Obenoskey began working for the defendant as an accounting manager in April 2006. She states that despite excellent performance, the defendant paid her less than a similarly qualified male employee because of her gender.
According to the lawsuit, on March 4, 2012, Obenoskey was injured when a horse fell on her. She states as a result of the injuries she received the defendant denied her customary annual raise. Obenoskey further claims the defendant failed to provide reasonable accommodations.
On April 8, 2013, Eastex Crude fired Obenoskey allegedly in retaliation for having opposed illegal conduct.
The defendant is accused of violating Obenoskey’s civil rights and failing to provide reasonable accommodations under the Americans with Disabilities Act Amendments Act.
The plaintiff is seeking an award of damages for back pay, front pay, reinstatement into her previous job, compensatory damages, interest, court costs and attorney’s fees.
Obenoskey is represented by Steven B. Thorpe and Carla S. Hatcher of Thorpe, Hatcher & Washington PLLC in Dallas.
A jury trial is requested.
U.S. District Judge Rodney Gilstrap is assigned to the case.
