Honda adds additional counsel in ATV rollover suit

Honda has enrolled additional counsel in litigation brought by the owner of a Honda all-terrain vehicle, who sued Cowboy Honda and manufacturer Honda North America, alleging the ATV is defective.

As previously reported, Dewayne Diggles and his wife, Sherry, filed the suit Sept. 8, 2011, in Jefferson County District Court. They are represented by Ernest Browne of Browne & Browne in Beaumont.

Court records show Honda filed the notice of appearance of additional counsel on Aug. 22, showing attorney David Fisher of Orgain, Bell & Tucker was also now representing the company.

The lawsuit alleges that on Jan. 1, 2010, Diggles was injured when a 2007 Honda Rancher 420TM ATV flipped over and landed on him.

The suit does not provide details of the incident.

The suit does, however, allege the ATV was defective and should not have been manufactured and sold by the defendants.

In his suit, Diggles is suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.

His wife is suing for loss of consortium and household services.

Judge Gary Sanderson, 6oth District Court, is assigned to the case.
