Area resident Timothy Parsley Jr. is suing Seaway Crude Pipeline, alleging the company let down a fence and allowed a cow to get loose, which he struck and killed with his truck.
The suit was filed Sept. 20 in Jefferson County District Court.
According to the lawsuit, on Aug. 2 around 11:30 p.m. Parsley was driving a Dodge truck on Labelle Road when all of a sudden a black cow appeared in his headlights.
“Despite trying to take evasive action to miss the cow, Mr. Parsley could not avoid the impact,” the suit states. “The impact was so severe that it injured (him), totaled his truck, and killed the cow.”
Parsley injured his neck, back, right arm, head and body in general in the collision.
The suit accuses Seaway of letting down landowners’ fences in the area to install a pipeline and negligently failing to make sure the fences were put back up after completing its daily work.
On top of punitive damages, the plaintiff is suing for his alleged past and future medical expenses, mental anguish, pain, impairment and lost wages.
