Collision in Frio County results in suit in Jefferson County

Jessie Curvin has filed suit against Strike LLC and its truck driver, Morgan Fleming, who caused an automobile collision in Frio County.

The suit was filed Sept. 23 in Jefferson County District Court.

According to the lawsuit, on March 16 Curvin was driving on I-35 in Frio County when Fleming, who was in the employment of Strike and driving a pick-up truck owned by the company, rear-ended him. 

The suit says venue is proper in Jefferson County because Fleming was a resident of the county at the time of the incident.

The suit accuses Fleming of negligently failing to maintain proper driver attention, control his rate of speed and maintain a safe distance between vehicles.

In addition to actual damages, the plaintiff is suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages.

Judge Gary Sanderson, 60th District Court, is assigned to the case.
