Suit against Diane’s Nails set for January trial

Unless a settlement is reached, Beaumont business Diane’s Nail’s will start 2014 in the courtroom as a personal injury suit brought by Verna Juarez has been slated for trial in January.

As previously reported, the suit was filed Nov. 16, 2012, in Jefferson County District Court. 

Court records show a discovery control plan order was entered on Aug. 6, calling for the case to be mediated on or before Dec. 30 or face a trial in January 2014.

The lawsuit alleges that sometime in December 2010, Juarez suffered serious and permanent bodily injury while at the defendant’s premises as a result of an alleged dangerous condition.

The suit does not state how the alleged injury occurred.

“Defendants and their agents … negligently allowed the creation and continued existence of this condition, so as the make defendants’ premises a dangerous place,” the suit states.

The suit further alleges the defendant should have warned the plaintiff of the unspecified dangerous condition.

Juarez is suing for her alleged past and future medical expenses, mental anguish, pain, impairment and lost wages.

Beaumont attorney Jared Gilthorpe represents her.

Judge Bob Wortham, 58th District Court, is assigned to the case.
