Office worker sues over improperly installed staircase

SHERMAN - An office worker has filed a lawsuit claiming she was injured after falling because of an improperly installed staircase. 

Shanda McCalib filed suit against Modular Space Corp., individually and doing business as Modspace, and Campbell Soup Supply Co. LLC, individually and doing business as Campbell Soup Co,. on Aug. 16 in Lamar County District Court. The defendants removed the case to the Eastern District of Texas, Sherman Division on Sept. 30.

According to the suit, the incident occurred on Aug. 17 while McCalib worked for Lazer Spot, which occupied the modular office space owned by the defendant.

McCalib states that she stepped out of the doorway of her workplace to walk down the staircase and before she could take her first steps down the stairs, her foot got caught on the platform causing her to fall.

According to the lawsuit, the stairs had shifted away from the building as a result of the staircase failing to be properly installed and maintained. Specifically, McCalib states that there were missing bolts that held the staircase secure.

The defendants are accused of negligence, strict liability, design defect and gross negligence.

The plaintiff is seeking an award of damages for medical expenses, pain, suffering, mental anguish, impairment, disfigurement, lost wages, loss of wage earning capacity, interest and court costs.

McCalib is represented by Kimberly A. Stovall and Molly F. Scott of Stovall & Associates in Dallas. A jury trial is requested.

U.S. District Judge Ron Clark is assigned to the case.
