HOUSTON - A couple from Canada has filed a lawsuit over an alleged auto-pedestrian accident which occurred two years ago in Fort Bend County.

In court documents filed Oct. 17 in the Houston Division of the Southern District of Texas, Merlyn and Beverley Spence allege that Kimberly Haddock struck Beverley as the latter was walking on Oct. 17, 2011.

The Spences, who moved to the area because of the husband's job responsibilities, explain that the wife was in the 22400 block of Westheimer Road at the time of the subject incident.

Beverley Spence passed an exit gate to the Haddocks' residence when the defendant motorist struck her with her car, according to the suit.

The couple asserts that Beverley Spence suffered "multiple broken bones and has endured multiple surgeries and physical therapy," stating she had tendons removed and is unable to walk to this day.

Meanwhile, Merlyn Spence requested his insurance company, TD Insurance Meloche Monnex, to settle with Haddock's insurer, GEICO, to no avail.

TD Insurance is also a defendant in the case.

A jury trial is requested.
