Lawsuit claims debt collector violated law by suing for student loan

SHERMAN - Claiming that a debt collector violated federal law by suing them in an attempt to collect a student loan, Cathy Zuniga and Josh Zuniga filed a lawsuit against Anh H. Regent, doing business as Regent & Associates, on Nov. 15 in the Eastern District of Texas, Sherman Division.

According to the court documents, Regent filed a lawsuit against the plaintiffs on Nov. 20, 2012, in Collin County Court in an attempt to collect a student loan owed by Josh Zuniga.

Zuniga states that the county court lawsuit was filed under a trust, which does not have the capacity to sue in Texas.

The defendants are accused of violating the Fair Debt Collection Practices Act, the Texas Debt Collection Act, and the Texas Deceptive Trade Practices Act for taking action prohibited by law, misrepresenting the character of a consumer debt, and using false representations and deceptive means to collect a consumer debt.

The lawsuit is seeking an award of statutory damages, actual damages, court costs and attorney’s fees.

The plaintiffs are represented by Fort Worth attorney Jerry J. Jarzombek.

A jury trial is requested.

U.S. District Judge Richard A. Schell is assigned to the case.
