SHERMAN - A Hurst woman has filed a lawsuit against her former employer claiming the company violated federal law by not paying her overtime compensation.
Donna Gonzales filed suit against Capital One Services on Nov. 21 in the Eastern District of Texas, Sherman Division.
Gonzales worked for the defendant from July 1998 to April 2013 at the Plano location. In her position with the defendant, she called customers to collect debt, handled loan documents, serviced small business loans, and worked to reduce interest on loans to persons in the military, according to the lawsuit.
She alleges that during one or more weeks of her employment, she worked in excess of 40 hours, but was not paid one and one-half times her regular rate of pay for each of her overtime hours worked.
The defendant is accused of violating the Fair Labor Standards Act, which prohibits the denial of overtime compensation for hours worked in excess of 40 per workweek.
The plaintiff is seeking an award of damages for unpaid overtime compensation, liquidated damages, attorney’s fees, interest and court costs.
Gonzales is represented by Charles L. Scalise and Daniel B. Ross of Ross Law Group PC in DeSoto. A jury trial is requested.
U.S. District Judge Ron Clark is assigned to the case.
