Man sues after insurance company fails to pay following accident

A man is suing after he was injured in a car crash and now claims the other driver's insurance has failed to pay him benefits.

Brett Harrington filed a lawsuit in the District Court of Jefferson County against Hoang Hai Pham, also known as Linh Cao Hoange Hai Pham. 

According to the complaint, on Feb. 22, Harrington was operating a motor vehicle and was involved in a collision with a motor vehicle operated by the defendant. The complaint claims that the defendant was negligent in the operation of the vehicle causing the collision and causing injuries to Harrington.

Harrington says that he has complied with the defendant's insurance company's policies in timely filing a claim but that the defendant's insurance company has failed and refused to pay any personal injuries benefits under the defendant's policy, the lawsuit alleges.

Harrington is seeking damages in excess of the jurisdictional limit.

He is being represented in the case by attorney B. Adam Terrell of Weller, Green, Toups & Terrell LLP.

The case has been assigned to Judge Gary Sanderson, 60th District Court of Jefferson County.
