Alleged collision between local motorists yields lawsuit

GALVESTON - Dickinson resident Maria Rojas is suing Texas City local Dillon L. Smith over an alleged two-vehicle accident that occurred between them in her city almost two years ago.

A lawsuit filed Dec. 26, 2013, in Galveston County District Court claims Smith is responsible for the subject wreck on May 4, 2012.

According to recent court papers, Rojas was driving near the intersection of FM 646 and West Walker Street when Smith's vehicle "violently" struck that of the plaintiff's.

"The impact of the collision caused the plaintiff to be tossed forward and backward within her vehicle, generally jarring her entire body," the original petition says.

Rojas further shows the purported collision caused her to suffer injuries to her back, neck, legs and chest in addition to a "bruised and battered" body.

She faults Smith for:


  • Failing to maintain a proper lookout;

  • Failing to maintain proper control;

  • Speeding; and

  • Failing to take evasive action.


Consequently, the complainant seeks unspecified monetary damages.

Attorney Kevin A. Murray of Houston is representing Rojas, and Galveston County 405th District Court Judge Michelle Slaughter is presiding over the case.
