Fraudulent transfer allegedly made to avoid paying court judgment causes lawsuit

A monetary judgement that has allegedly been left unsatisfied has led to litigation.


15625 Ft. Bend Ltd., doing business as Mercedes-Benz of Sugar Land, filed suit in the Galveston County District Court naming Sam Allen, also known as Samir Shukri, Penny Elizabeth Shukuri and Joseph Robert Shukuri as defendants. 

According to Mercedes-Benz, it hired Samir Shukri to perform services on its building which involved sandblasting. MB claims it hired Shukri after he told them his work was insured, but it was not. MB says Shukri caused about $66,000 worth of damage to its property, and later went to court and got a judgment against him in that amount.

After MB received the judgement against Shukri, it alleges Shukri transferred assets from its company in order to avoid paying the judgment. MB claims the transfer was fraudulent and has filed this suit to cancel the transaction or access the transferred assets to satisfy its judgment against Shukri.

MB is seeking an undisclosed amount in damages.
