Palisade Palms sues Phase I developer

East Beach Project Phase II Ltd. filed a lawsuit March 14 in the Galveston County Court against East Beach Project Phase I Ltd., citing breach of contract, quantum meruit and promissory estoppel. 



The complaint states the plaintiff is the developer of the second phase of the Palisade Palms Master Plan, which is a condominium development located near the 800 block of E. Beach St. in Galveston.


As part of the Palisade Palms Master Plan, the plaintiff provided to the defendant numerous things, including financial contributions and restrictions on the plaintiff's property for the benefit of the defendant, according to the complaint.


The plaintiff claims the defendant agreed to pay off, refinance or restructure all loans taken by the plaintiff for the benefit of the defendant, repay the plaintiff for all financial contributions, remove all encumbrances and liens on the plaintiff's property and provide material and financial support to the efforts of the plaintiff.


The plaintiff contends the defendant has failed to perform any of the agreements, which is a breach of contract.



The plaintiff is seeking damages in excess of the jurisdictional minimum, including fees and costs.
