A Jefferson County woman is suing after her husband was fatally shot and their insurance company failed to settle the life insurance claim.

Mary Breaux filed a lawsuit March 28 in the Jefferson County District Court against American General Life Insurance Co., River Shynette Gobert and Jonathan Demond Patton.

According to the complaint, on June 23, 2013, Breaux's husband Daryl Fontenot was robbed and fatally shot by Gobert and Patton, who are accused of wrongful death. The lawsuit says Breaux purchased life insurance on her husband from American General Life Insurance Co. before his death, which was a circumstance covered by the policy.

Breaux says American General has failed to settle the claim and accuses it of anticipatory breach, breach of contract, noncompliance with Texas insurance code in unfair settlement practices and prompt payment of claims, breach of the duty of good faith and fair dealing, and fraud.

Breaux is seeking more than $1 million in damages and full life insurance policy benefits.

She is being represented in the case by attorney Michael J. Lindsay of Lindsay, Lindsay & Parsons in Beaumont.
