Accidentpedestriandeath

A Texas resident and Hitchcock bar are facing suit after an allegedly intoxicated man struck a deputy sheriff.

Wilford Lloyd Garvin filed a lawsuit April 16 in the Galveston County Court against Phillip Gilliam, Deleon & Erskins Investments LLC and Water's Edge Bar & Grill, citing negligence and vicarious liability.

The complaint states Garvin was working as a deputy sheriff for the Galveston County Sheriff’s Department and was directing traffic at the scene of an accident in the 1200 block of Interstate Highway 45 in Texas City on Dec. 29.

The court document says Gilliam refused to exit with the other traffic, tried to go around Deputy Garvin’s police vehicle and struck the plaintiff, causing serious injuries. Gilliam admitted he consumed large amounts of alcohol at Water's Edge Bar & Grill prior to the collision, according to the complaint.

Garvin is seeking damages within the jurisdictional limits of the court.

The plaintiff is being represented in the case by Robert A. Schwartz of Brent Coon & Associates.
