FedEx Freight faces suit after driver causes accident

Two San Antonio women are suing after the vehicle they were in was struck by a truck driver.

Marleen Garza and Mary Potocny-Krider filed suit May 20 in the Jefferson County District Court against FedEx Freight Inc. and Vernon Jay Chaisson, citing negligence. 

According to the complaint, the plaintiffs were traveling east on Interstate 10 in Beaumont on Nov. 12, 2012, when they stopped their vehicle due to traffic.

At the same time defendant Chaisson, who was driving a vehicle owned by FedEx Freight, failed to slow down behind the plaintiffs' vehicle and collided with it, pushing the plaintiffs' vehicle ahead into other vehicles and causing severe injuries to Garza and Potocny-Krider, according to the suit.

Chaisson is accused of failing to exercise care, operating a vehicle in an unsafe manner and failing to take appropriate evasive action.

FedEx is accused of negligent hiring and negligent training.

The plaintiffs are seeking damages in excess of the jurisdictional minimum of the court.

They are being represented by attorneys Paul F. Ferguson Jr., Ryan M. Schaper and Cody A. Dishon of Provost Umphrey Law Firm in Beaumont.
