TWIA, National Lloyds sued after denying home damage claims

A Jefferson County couple is suing over claims their insurance companies have wrongly denied their home damage claims. 


Henry and Dorothy Como filed a lawsuit May 23 in the Jefferson County District Court against Texas Windstorm Insurance Association and National Lloyds Insurance Co., citing breach of contract.


According to the complaint, the Comos' property, insured by the defendants, on Lansing Avenue in Port Arthur sustained wind damage March 20, 2012, and water damage June 1, 2012.


The plaintiffs say both their claims to Texas Windstorm Insurance and National Lloyds Insurance were wrongly denied after negligent inspections, and the companies' failure to pay has rendered them unable to perform proper repairs.


The defendants are accused of breach of contract, violations of the Deceptive Trade Practices Act, violations of the Texas Insurance Code, good faith and fair dealing, fraud and conversion.


The Comos are seeking damages and attorney's fees.


They are being represented in the case by attorneys Clint Brasher and Joe Muckleroy.
