Ownership of Nederland property cause of filed suit

Title deeds

Three parties are asking the court to ascertain the rightful owner of property in Nederland.


Salvador V. Torres filed suit July 11 in the Jefferson County District Court against Rachel Torres and Alejandro Torres. 


According to the complaint, on April 13, 2007, the named parties entered into an agreement where the plaintiff would give the defendants $25,000 to purchase property at 129 Second Ave., Nederland, on the plaintiff's behalf.


The property required improvements, so the defendants' names were put on the property title for the purpose of securing a loan, the suit states.


Since the purchase, the plaintiff claims to have paid all mortgage and property tax costs for the property. However, defendant Rachel Torres is now attempting to claim ownership of the property and is refusing to recognize that Salvador Torres has been the sole party living on, and being financially responsible for, the property in question, according to the filing.


The defendants are accused of breach of contract, unjust enrichment, adverse possession, fraud, trespass to try title, promissory estoppel and statutory fraud.


The plaintiff is seeking the property title, actual damages, fees and costs.
