Woman claims driver caused rear-end collision while talking on cell phone

A woman incurred medical costs after a driver who was talking on a cell phone rear-ended her vehicle, according to a recently filed lawsuit.


Aylonda Kelley filed a lawsuit July 18 in the Jefferson County District Court against Kelli Smith. 


In her complaint, Kelley claims she was stopped for a red light July 13, 2012, in Beaumont when Smith failed to control her speed and struck the back of Kelley’s vehicle.


In addition to her medical costs, Kelley claims she lost earnings and her earning capacity, suffered physical impairment and endured physical pain and mental anguish because of the collision.


Kelley blames Smith for causing the collision, saying she negligently failed to maintain control of her vehicle, failed to keep a proper lookout and failed to control her speed.


Kelley seeks an unspecified judgment, plus pre-judgment interest, costs and other relief the court deems just.


She is being represented by attorney Jonathan Juhan and J.J. Bragg of Beaumont.
