Driver files lawsuit against driver who struck side of vehicle

Side swipe wreck

A driver claims she endured medical costs when another driver attempted to exit a driveway and struck her vehicle in the process.

Denise Sandoval filed a lawsuit July 21 in the Galveston County District Court against Teresa Jean White.

In her complaint, Sandoval claims she was driving west on Seawall Boulevard on March 10, 2013, when White suddenly attempted to exit a private drive, striking the side of her vehicle.

In addition to her medical costs, Sandoval suffered serious injuries, endured physical pain and mental anguish and sustained physical impairment due to the collision, according to the lawsuit. She also suffered disfigurement, lost her income and experienced a reduced wage earning capacity, the suit states.

She blames White for causing the collision, saying she negligently failed to keep a proper lookout, failed to timely apply her brakes, failed to yield the right-of-way, failed to keep a clear distance between her vehicle and White’s vehicle, failed to control her speed, failed to control her vehicle and failed to exercise ordinary care.

Sandoval is seeking a judgment in excess of the minimum jurisdictional limits of the court, plus pre- and post-judgment interest, costs and other relief the court deems just.

She is being represented by attorney Wade D. Moriarty of The Crim Law Firm in Houston.
