Woman files lawsuit against driver who rear-ended her vehicle

A woman is condemning the speed of another driver, saying he was driving too fast when he rear-ended her vehicle.

Patricia Nash filed a lawsuit July 25 in the Jefferson County District Court against Jimmie Hayes Jr.

In her complaint, Nash alleges she was driving north in the 1000 block of Interstate 10 on the service road on Nov. 30, when she stopped at a yield sign to merge onto College Street heading eastbound.

Suddenly, Hayes, who was driving behind her, failed to control his speed and struck the back of her vehicle, according to the complaint.

Due to the collision, Nash incurred medical costs, experienced physical pain and suffering and endured physical impairment, the suit states. She also incurred property damages, lost earnings and endured mental anguish, the complaint says.

Nash blames Hayes for causing the collision, saying he negligently failed to keep a proper lookout, failed to keep a clear distance between his vehicle and hers, drove too fast, failed to timely apply his brakes and drove without a license.

Nash seeks a judgment in excess of the minimum jurisdictional limits of the court, plus pre- and post-judgment interest, costs and other relief the court deems just.

She is being represented by attorneys Chris M. Portner and J. Trenton Bond of Beaumont.
