Settlement reached in trip & fall suit brought over minor’s injuries

An agreed final judgment has been entered in a lawsuit brought by a local mother, who sued a woman after her daughter tripped and fell at the woman’s residence.

Earlier this year, Shelly Welch filed, individually and as next friend of minor Marena Welch, against Cheryl A. Robinson of Groves in Jefferson County District Court, claiming injuries incurred by the child in November 2014.

According to the filing, on Nov. 26 the minor tripped and fell at the defendant’s Groves residence, resulting in injuries to Marena Welch that required medical diagnosis, care and treatment.

Court records show that the final judgment was entered on June 5 and states the parties agreed to settle the matter for $11,310.

The suit states that the defendant carried a standard Texas homeowners’ insurance policy underwritten by National Lloyds Insurance Co., which offered a settlement.

The plaintiff asserted that Marena Welch suffered a broken forearm along with a sprained wrist in the fall; and that she and her child have collectively sustained medical expenses, past physical pain and impairment; disfigurement; and mental anguish.

In her suit, Welch said the compromise settlement pended court approval.
