Texas worker sues Manbro Contracting, Eco Waste and Recycling, alleging unpaid overtime

A Texas worker is suing his former employers, alleging unpaid overtime wages.

Fredy Ordonez, individually and for all others similarly situated, filed a collective action lawsuit Aug. 12 in the Houston Division of the Southern District of Texas against Eco Waste and Recycling and Manbro Contracting, alleging failure to pay overtime wages, in violation of the Fair Labor Standards Act.

According to the complaint, Ordonez worked for the defendants as a garbage collector from May 2014 to February 2015, collecting garbage from designated routes in residential areas. The suit says Ordonez regularly worked 60 hours or more per week but was not paid an overtime premium for hours worked beyond 40 hours per week.

The lawsuit further alleges other members of the class worked similar hours and were also not paid an overtime premium.

Ordonez and others in the collective suit seek to recover unpaid overtime compensation, liquidated damages and attorney fees. The plaintiff is represented by attorney Josef F. Buenker of Houston.
