Harris County couple sues Geico, seeking full payment of accident claim

A Harris County couple is suing Geico, alleging refusal to pay for damages caused by by an uninsured motorist.

Byron and Anetra Mickens filed a lawsuit June 12 in Galveston County District Court against Geico, alleging breach of contract, breach of duty of good faith and fair dealing.

According to the complaint, on June 13, 2013, Byron and Anetra Mickens and their children were injured when an uninsured driver caused a collision on state Highway 45 South in Galveston County.

Under the terms of the insurance policy purchased from Geico--which included uninsured/underinsured auto insurance coverage--the defendant is contractually bound to pay all damages caused by the uninsured motorist, the suit says. The plaintiffs allege that not only has the defendant underpaid the claim, but it continues to delay any settlement.

The policy was entered into five months before the accident, the suit says, and the plaintiffs paid the policy in full.

The Mickenses seek a jury trial, damages between $100,000 and $200,000, attorney fees, court costs, penalties and expenses. They are represented by attorney Jason E. Payne, of The Payne Firm in Houston.
