A Houston driver technician is suing a transport company, alleging unpaid overtime wages for services rendered.

Alicia Debree Davis, of Houston, filed a lawsuit Aug. 31 in the Houston Division of the Southern District of Texas against Houston Kiddie Express Transit Service (HKETS), Larna Martin and Harry Brown, alleging violation of the Fair Labor Standards Act.

According to the complaint, Davis was hired June 20, 2013, and has worked a "driver technician," transporting patients to physicians' offices and clinics. HKETS is a Houston-based non-profit organization, for whom Martin and Brown worked and directly oversaw Davis as an employee.

The suit says Davis also performed work utilizing products manufactured outside Texas and worked on and handled goods likewise moving in interstate commerce, i.e. fuel. For each hour worked more than her 40-hour work week, the plaintiff was supposed to be paid 1 1/2 times the regular rate, as provided for in the Fair Labor Standards Act, the suit says.

The plaintiff alleges she was not paid overtime and is entitled to an award of liquidated damages in the amount of which she was not paid, plus interest.

Davis seeks a jury trial, compensatory damages, attorney and court costs, and all other out-of-pocket fees and other damage relief as the court sees fit. She is is represented by attorneys Charles S. Scalise and Daniel B. Ross of the Ross Law Group in Austin.
