Shipley Donuts sued over unpaid overtime allegations

A Texas man is suing his former employer over claims of unpaid overtime wages.

Merari Antonio Castrejon, individually and for all others similarly situated, filed a collective action complaint Sept. 9 in the Houston Division of the Southern District of Texas against Michael R. Williams, individually and doing business as Shipley Donuts, alleging unpaid overtime in violation of the Fair Labor Standards Act.

The complaint states that during the time Castrejon worked for Shipley Donuts, from June 2013 to August 2015, he regularly worked more than 60 hours per week but was not paid time-and-a-half for hours worked in excess of 40 hours per week.

The complaint states that Castrejon was not an exempt employee under the FLSA, and is therefore entitled to overtime compensation.

Castrejon and others in the class seek to recover unpaid overtime compensation, liquidated damages, and attorney fees and court costs. He is represented by Josef F. Buenker of Houston.
