A Delaware-based insurance company doing business in Houston is suing a former employee, alleging breach of fiduciary duty and breach of contract.
HCC Insurance Holdings Inc. filed a lawsuit Sept. 4 in the Houston Division of the Southern District of Texas against Michael Remeika, who most recently had worked as senior vice president of the company.
According to the complaint, Remeika, with confidential information about HCC in hand, formed his own company, Creative Risk Underwriters. The suit says the defendant, while still employed by the plaintiff, hired away its vice president of marketing.
The lawsuit states that action breached both the stock option agreements as well as the fiduciary duty the defendant owed the plaintiff.
HCC Insurance Holdings seeks damages caused by the defendant and exemplary damages because of Remeika's allegedly willful and malicious disregard to the plaintiff's rights. A jury trial is also sought, plus attorney fees and court costs. The plaintiff is represented by attorneys Mark D. Temple, Peter Stuhldreher and Carmen Jo Rejda-Ponce of Reed Smith LLP in Houston.
