Two workers allege Prime Consulting failed to pay overtime

HOUSTON -- Two former co-workers are suing a management services corporation with an office in Stafford, alleging unpaid overtime.

Cicely James of Brandon, Fla., and Ken Rice of Melissa, individually and on behalf of others similarly situated, filed a collective action lawsuit Sept. 21 in the Houston Division of the Southern District of Texas against Prime Consulting Group, Inc., Keith Bruce and Chihuahtha Compton. 

Prime provides claims management services to insurance companies through a workforce of claims adjusters. According to the complaint, the plaintiffs and at least 20 others, were misclassified as independent contractors while performing work for State Farm since early 2014. 

The plaintiffs allege this misclassification kept them from earning overtime pay for any hours worked in an excess of 40 in a week, as required under the Fair Labor Standards Act. 

James and Rice seek the overtime wages due, proper payments of all federal withholdings and taxes to the IRS, court costs and attorney fees. They are represented by attorneys Michael A. Starzyk, April L. Walter and Megan M. Mitchell of Starzyk & Associates PC in The Woodlands.
