Couple sues 21st Century Centennial Insurance, seeks uninsured benefits

Benefits

A Hitchcock couple is suing an insurance company, seeking uninsured benefits they allege they're owed following a vehicle collision.

Timothy Webb and Rita Webb filed a complaint July 1 in Galveston County District Court against 21st Century Centennial Insurance Company, alleging breach of contract.

On July 1, 2011, the complaint states, Timothy Webb was involved in a vehicle collision in Galveston caused by David Alan McCann, from which Webb sustained personal injuries, including a traumatic brain injury, and Rita Webb sustained additional damages from her husband's injuries.

At the time, the Webbs were covered under an insurance policy with the defendant, which included a policy for coverage for uninsured and underinsured motorists, the suit says. Although McCann had liability insurance coverage, it did not sufficiently cover the extensive damages the plaintiffs suffered as a result of the accident, the lawsuit states.

Timothy Webb informed Centennial Insurance defendant of the accident July 19, 2011, with the intention to claim underinsured benefits, but the complaint alleges the defendant has failed to pay for the damages under its insurance policy with the Webbs.

The Webbs seek monetary relief between $100,000 and $200,000, plus interests and court costs. They are represented by attorney Ramzey Zein-Eldin of Galveston.

Galveston County District Court case number cv-0074591.
