Employee alleges Breakpoint Services did not pay overtime

HOUSTON — A worker is suing his former employer, alleging he did not receive overtime compensation.

Mario Rodriguez filed a complaint Oct. 5 in the Houston Division of the Southern District of Texas against Breakpoint Services, alleging unpaid overtime wages in violation of the Fair Labor Standards Act.

From September 2014 to May 2015, the complaint states, Rodriguez was employed by the defendant as a customer service representative in the mail room of the Heritage Plaza Office building in Houston, delivering in-office supplies and packages.

During this time, Rodriguez received $9.50 per hour salary and worked approximately 14 hours of overtime per week, but was not compensated for any time worked more than 40 hours per week, the suit says.

Rodriguez seeks unpaid overtime compensation, minimum wages, liquidated damages, attorney fees and costs. He is represented by attorneys Thomas H. Padgett Jr., Charles L. Scalise and Daniel B. Ross of Ross Law Group in Bellaire and Austin.
