New Mexico resident sues Oil States Industries, alleging unapid overtime

A New Mexico resident is suing an oil and gas industry services company, alleging unpaid overtime.

John Whann, of Roswell, N.M., individually and for all others similarly situated, filed a collective action lawsuit Oct. 22 in the Houston Division of the Southern District of Texas against Oil States Industries, alleging unpaid overtime wages in violation of the Fair Labor Standards Act.

The complaint states that while Whann has been employed by the defendant as a field service technician, from October 2011 to the present, he worked an average of 115 hours per week and was paid a flat salary of $54,000 per year, plus bonuses.

The complaint alleges Whann was not paid an overtime premium for time worked more than 40 hours per week.

Whann and others in the class seek damages for unpaid overtime, liquidated damages, injunctive and declaratory relief, plus attorneys fees and costs. He is represented by attorneys Charles L. Scalise and Daniel B. Ross of Ross Law Group in Austin.
