Harris County pedestrian sues Metro City Construction, driver following accident

A Harris County woman is suing a construction company and one of its employees over injuries the plaintiff says she sustained in a vehicle-pedestrian collision.

Jamie Lopez filed a lawsuit July 8 in Galveston County District Court against Metro City Construction, MCC Interests, and Martin Amaro-Almanza, of Pasadena, alleging negligence and gross negligence.

On June 10, the complaint states, Lopez was parked on the west curb near 5000 Meadow Lark Street in Dickinson, when Amaro-Almanza pulled in front of her vehicle and came to a stop.

While he was stopped, Lopez approached his driver side window and began to have a conversation with him. After a few minutes, the suit alleges, Amaro-Almanza took his foot off the brake, pressed the gas pedal, and swerved his vehicle to the left, striking Lopez and knocking her to the ground, where she was run over by the rear tire of Amaro-Almanza's vehicle.

According to the complaint, Amaro-Almanza left the scene. At all relevant times, Amaro-Almanza was operating in the scope of his employment with Metro City Construction and MCC Interests, the suit says.

The suit says Lopez suffered permanent and life-altering injuries.

The lawsuit states the defendants were negligent in failing to use due caution, failing to stop and render aid after a collision involving personal injury, driving in willful and wanton disregard for the safety of persons on the roadway, negligent hiring and retaining, and other negligent acts or omissions.

Lopez seeks monetary relief of more than $1 million, interests and costs of the suit. She is represented by attorney Joe Lopez of the Lopez Law Firm in Austin.
