BP sues two businesses, alleging non-payment of fees

An oil company is suing two businesses, alleging they did not reimburse attorney fees and costs in an underlying suit.

BP Products North America filed a lawsuit Oct. 23 in Galveston County District Court against JV Industrial Companies and Miken Specialties, alleging breach of contract.

According to the complaint, on Feb. 26, 2008, at a BP refinery in Texas City, Israel Sanchez, an employee of JV, was climbing down a ladder on temporary scaffolding when a scaffold pole, erected by Miken, came loose and caused him to lose his balance and fall through a hole that was created by Miken at the request of JV.

Sanchez sued BP in Galveston County in a case styled Israel Sanchez v. BP Products North America Inc., which the trial court granted summary judgment in BP's favor on Oct. 26, 2011.

Despite demand, the suit alleges, JV and Miken have failed to reimburse BP for its attorney fees and defense costs in successfully defending the suit.

BP seeks reimbursement of attorney fees and costs of defense in the underlying suit, plus attorney fees and court costs. BP is represented by attorney James B. Galbraith of Galveston.
