Insurance firm sues Bac Trac Plumbing, alleging negligence in clamp installation

An insurance company is suing a plumbing company, alleging negligence regarding property damages resulting from the bad installation of clamps.

Phillips Irrevocable Trust and Scottsdale Insurance Company, as subrogee of Phillips Irrevocable Trust, filed a lawsuit July 1 in Galveston County District Court against Bac Trac Plumbing, alleging negligence.

The suit states Phillips Irrevocable Trust owned a residential home at 106 Bora Bora Drive in Tiki Island, which was insured by Scottsdale Insurance. During construction of the property, Bac Trac installed certain clamps on the cold water line to the water heater, the lawsuit states.

On July 6, 2013, the suit alleges, due to being over-stressed when installed by the defendant, the clamps broke and released water throughout the property.

The suit alleges Bac Trac was negligent its installation of the clamps. The property was substantially damaged as a result, the suit says, and Scottsdale Insurance made payments to Phillips Irrevocable Trust in the amount of $215,706.24.

The plaintiffs seek to recover compensatory damages and interests. They are represented by attorney Hobart M. Hind of Butler Weihmuller Katz Craig in Tampa.
