Hawaii man sues League City couple, alleging infliction of emotional distress

A Hawaii man is suing a League City couple, alleging emotional distress inflicted upon him.

Paul Carlton filed a lawsuit Nov. 3 in Galveston County District Court against Russell Milam and Johanna Carlton, known as Johanna Milam, alleging intentional infliction of emotional distress and civil conspiracy.

Carlton and Johanna were previously married but divorced in June 2013 following a "less than blissful" relationship, the suit says.

Shortly after the divorce, upon learning Paul Carelton was in a new relationship, the suit alleges Johanna's behavior became increasingly erratic, confrontational and angry. She sought new litigation against Carleton to modify their custody arrangement, to which the plaintiff counter-sued, the complaint says.

In December 2013, primary custody of their children was removed from Johanna and given to Paul, but the suit alleges Johanna "reacted" to this by "making Paul's and the children's lives so miserable" that he agreed to return them to her in July 2014.

In September 2014, the complaint states, Johanna again initiated a lawsuit against Carleton to further restrict his access to the children, alleging he had possession of various contraband, which the plaintiff denies.

During this time, Johanna had come into possession of certain medical and mental health records of Carleton's , which, after she remarried Russell Miram, Miram delivered to the League City Police Department in April 2015, in violation of Carleton's privacy rights and for the deliberate purpose of causing him to suffer emotional distress, the suit alleges.

Paul Carleton seeks general, special, punitive and exemplary damages, plus costs of the suit. He is represented by attorney Todd Frankfort of Flowers & Frankfort in Houston.
