Houston man sues American Zurich Insurance, alleging denial of benefits

A Houston man is suing an insurance company, alleging it denied workers compensation benefits.

Willis Floyd Wiley filed a lawsuit Nov. 3 in the Houston Division of the Southern District of Texas against American Zurich Insurance Company, alleging violations to the Fourteenth Amendment of the U.S. Constitution.

Wiley's father, Lee Otis Ryan, worked as a switchman for Rescar Industries in Houston. According to the complaint, on Nov. 11, 2008, Ryan was killed while switching rail cars. American Zurich carried workers compensation benefits for Ryan but the suit alleges it has denied Wiley's right to his father's workers compensation in death benefits.

Wiley seeks emotional distress damages of $5 million, compensatory damages of $5 million and punitive damages of $10 million. He is representing himself.
