San Antonio company sues Kroger, Sun Builders, alleging non-payment for materials

A San Antonio company is suing two businesses and an individual, alleging an unpaid balance owed for products sold.

Alamo Concrete Products Company, doing business as Dorsett, filed a lawsuit Nov. 3 in Galveston County District Court against Kroger Texas, Sun Builders Co. and William Javier Garcia.

 According to the complaint, Kroger owns a construction project at 2750 E. League City Parkway, League City, for which Dorsett supplied concrete. The general contractor of the project is Sun Builders.

The suit says on Sept. 15, Dorsett sent copies of its July 2015 invoice for the unpaid balance of $50,561 to Sun and a copy was also sent to Kroger on the same day. A second notice was sent to Kroger Sept. 28, the suit says. Garcia controls the disbursement of the funds, the lawsuit alleges, and he should be the party to pay the $50,000. 

Dorsett seeks damages in the principal sum, interest, attorney fees and other costs of court. It is represented by attorneys Ronald S. Schmidt and Louis A. Wenzel of Schmidt & Wenzel in San Antonio.
