Tyler worker alleges Packers Sanitation Services did not pay overtime

A Tyler man is suing a sanitation services company, alleging unpaid overtime.

Jose A. Berrios Yanes Jr., individually and for all others similarly situated, filed a collective action lawsuit Nov. 18 in the Marshall Division of the Eastern District of Texas against Packers Sanitation Services, alleging unpaid overtime wages in violation of the Fair Labor Standards Act.

According to the complaint, during the time Yanes was employed by the defendant as a sanitation worker at its John Soules Food facility in Tyler, he regularly worked 60-70 hours per week. The suit alleges Yanes and others were not paid an overtime premium for time worked more than 40 hours per week.

Yanes and others in the collective seek to recover unpaid overtime, liquidated damages, attorney fees and court costs. He is represented by attorney William S. Hommel Jr. of the Hommel Law Firm in Tyler.
