HOUSTON – A longtime roofer is suing a a Houston roofing company, alleging failure to pay overtime.

Eleno Flores filed a lawsuit Jan. 8 against PRC Roofing and Daniel A. Delgado, both of Houston, in the Houston Division of the Southern District of Texas, alleging a violation of the Fair Labor Standards Act of 1938.

According to the complaint, Flores, who worked as a roofer for 30 years at PRC, worked a minimum of 22 hours of overtime each week and often worked 27 hours of overtime each week. The suit says he was paid $18 per hour each week for 40 hours of work, but was never paid time and a half for time worked in excess of 40 hours in any one work week.

Flores seeks a jury trail, legal costs, pre- and post-judgment damages and all equitable relief the court deems just. He is represented by attorneys Robert J. Filteau, John A. Sullivan III of The Law Offices of Filteau & Sullivan Ltd in Houston.
