HOUSTON - A Texas man is suing a Houston-based supplier to the liquid bulk chemical industry, alleging it did not pay him overtime wages.

James Frank filed a lawsuit Jan. 25 in the Houston Division for the Southern District of Texas against ODFjell Terminals (Houston), alleging violations of the Fair Labor Standards Act.

The suit states when Frank worked for the defendant as a terminal operator, he regularly worked more than 40 hours per week and was paid by the hour.  The lawsuit alleges ODFjell failed to pay Frank an overtime premium for time worked more than 40 hours per week.

Frank seeks actual damages in back overtime wages, liquidated damages, interests, attorney fees and costs of the suit. He is represented by attorney Shelly Davis-Smith of The Davis Law Firm in Houston.
