Oilfield workers allege BTI Services, Warrior Energy failed to pay overtime

HOUSTON — Two oilfield workers are suing two oil services companies, alleging failure to pay overtime.

Michael Allen and Nathan Scott Harris filed a collective action lawsuit Dec. 23 in the Houston Division of the Southern District of Texas against BTI Service Inc. and Warrior Energy Services Corporation, alleging violations of the Fair Labor Standards Act (FLSA).

According to the complaint, Allen and Harris, on behalf of themselves and all others similarly situated, say they performed largely technical and manual labor jobs for the defendants, working 12-hour shifts, seven days a week as flow back operators, well test operators, and other oilfield operations. The suit says Allen and Harris performed duties that included rigging up and rigging down oilfield equipment, operating oilfield machinery, and reporting daily activity to their supervisors.

According to the lawsuit, the plaintiffs never received time and a half compensation for time worked in excess of 40 hours per week. They allege failure to do so was done willfully in violation of the FLSA.

Allen and Harris seek damages for unpaid overtime compensation, liquidated damages, reasonable attorneys’ fees, costs, expenses and a trial by jury. They are represented by attorneys Robert J. Filteau and John A. Sullivan III of The Law Offices of Filteau & Sullivan in Houston.
