Family of dead motorist seeks to resolve matter with driver who caused accident

GALVESTON – The family of a man killed in a vehicle crash is suing the motorist it says caused the accident, requesting they resolve their differences in court.

The estate of Kevin Munson on Feb. 9 filed a lawsuit in the Galveston County District Court against Dena Lynn McKenzie, demanding she appear in court to settle their differences in connection with the death of Munson, who was killed in a vehicle crash.

According to the complaint, prior to his death, Kevin Munson was single and had two minor children, who are his only heirs under the Texas law of intestacy. He also died without a will, the suit says, and Monica Schmidt, Munson’s ex-wife, is a representative of his estate.

The lawsuit states on March 13, 2014, McKenzie negligently caused a vehicle crash that resulted in Munson’s death. According to the lawsuit, both parties have reached an agreement without any admission of liability.

The lawsuit requests McKenzie appear in court to settle their differences and recover actual damages from the fatal crash and any applicable interest.

The estate of Kevin Munson seeks monetary relief of no more than $100,000, including damages of any kind, penalties, costs, expenses, pre-judgment interest and fees, if applicable. The estate is represented by attorney Lawrence M. Tykla of the Tykla Law Center PC in League City.
