BEAUMONT – A Jefferson County teenager is suing a Beaumont family, alleging he was shot at least six times at their home, while visiting their daughter.

Tyler Bennett Cox filed a lawsuit Feb. 5 in Jefferson County District Court against Casey O’Neil Foster, Jessica Foster and Foster Safety, alleging gross negligence and assault with infliction of bodily injury.

According to the complaint, on the night of March 15, 2013, Cox went to visit the Foster’s daughter, also a teenager, at their Beaumont home, where they watched television and he fell asleep on the floor, waking up about 5 a.m. He said he decided to climb out a window and asked the Foster’s daughter if the alarm off. At some point, the mother, Jessica Foster, grabbed her daughter, screamed and they both went into the bathroom, where the mother loudly closed the bathroom door, the suit says.

   

Almost immediately, according to the lawsuit, Casey O’Neil Foster, the girl's father, pointed a handgun at Cox and starting shooting, hitting him with at least six shots. At one point the gun jammed and, the lawsuit says, Foster told Cox ``You better be glad the gun jammed.”

The plaintiff alleges he suffered a chest wound, a blown index finger and clipped thumb.

Cox, seeks a jury trial, at least $1 million as well as damages for physical pain and mental anguish. He is represented by attorneys Larry Watts and Melissa Azadeh of the Watts & Company Lawyers, LTD of Missouri City.
