Former employee alleges energy services company failed to follow overtime rules

HOUSTON — A former employee is suing a Tyler company, alleging failure to pay overtime.

Orlando Guerra, individually and on behalf of all others similarly situated, field a class-action lawsuit March 21 in the Houston Division of the Southern District of Texas against Torqued-up Energy Services Inc., Kelly Prentiss, Bruce M. Rothstein, John Jameson and Joseph R. Dee, IV, alleging unpaid wages and violation of workers compensation acts. 

According to the complaint, Guerra worked as an equipment operator for more than 40 hours per work week but did not receive any overtime pay for those extra hours. The plaintiff alleges the defendants were fully aware that their employees were working more than 40 hours per week but chose not to pay them overtime wages.

Guerra seeks a trial by jury, all damages, unpaid overtime wages, back wages withheld, all legal fees and any other relief the court deems just. He is represented by attorneys Clif Alexander, Austin W. Anderson and Lauren E. Braddy of Phipps Anderson Deacon LLP in Corpus Christi.
