MARSHALL — A former employee is suing a Florida construction company, alleging failure to pay overtime.

Cody D. Delaney of Frankston, on behalf of himself and all others similarly situated, filed a class action lawsuit March 29 in the Marshall Division of the Eastern District of Texas against Core Construction & Development Inc. of Pompano Beach, Florida, alleging failure to fairly compensate employees.

According to the complaint, Delaney worked for more than 40 hours per week for Core but did not receive any overtime pay for those excess hours. The plaintiff alleges Core Construction paid its employees at a salary basis regardless of how many hours the employees worked at a given work week and it failed to maintain accurate records of employees' total working hours.

Delaney seeks trial by jury, unpaid wages and overtime, liquidated damages, all legal fees and any other relief the court deems just. He is represented by attorney William S. Hommel Jr. of Hommel Law Firm in Tyler.
